Licensed real estate professionals in BC are required to make disclosures in a variety of situations. These disclosures not only help consumers make informed decisions, but they also help you, as a licensee, reduce your own risk of liability. One situation that can be easily overlooked is when you serve on a strata council for a corporation in which you are an owner. To ensure you meet your obligations, here are the steps you should follow:
- Request that an item be added to the next strata council meeting agenda, so you can acknowledge that you are serving on the strata council while licensed.
- Obtain and complete the BCFSA Disclosure of Management of Strata Corporation by Licensee Who is an Owner form.
- Make it clear, and ensure it is noted in the council meeting minutes, that you are acting solely as a council member, not as a licensee.
- Have two other strata council members sign Part C of the disclosure form, acknowledging its receipt.
- Provide a signed copy of the disclosure form to your managing broker, so your disclosure is properly recorded.
